Last Chance: The Saving American Democracy Amendment

Of all the extraordinary things going on in the world right now, I don't believe there is an outcome that is more essential to assuring that our children can survive the corporatocratic nightmare blueprinted by SCOTUS' Citizen United decision, than the Saving American Democracy Amendment offered by Senator Bernie Sanders, of Vermont.

January 24, 2011- Today, we asked the Justice Department to bring criminal charges against Supreme Court Justice Clarence Thomas for making false statements on his Financial Disclosure forms every year since 2003 by falsely swearing under criminal penalty that his wife Virginia had no income. Justice Thomas signed these forms under oath after certifying that the information in them was true and accurate.

Virginia Thomas worked at the Heritage Foundation from 2003 through 2007 and earned at least $120,000 each year according to the foundation’s Form 990s. She is now working for Liberty Central in a paid position according to its CEO Sarah Field. Last Friday, Common Cause wrote to the Administrative Office of the Courts about this matter as was reported by the Los Angeles Times on Saturday.

And remember, Common Cause has called into question whether Justice Thomas and Justice Scalia were ethically challenged by their involvement in the Citizens United ruling -- a ruling that Virginia Thomas may have benefited from:

Justice Thomas' wife also may have directly benefitted from her husband's vote in Citizens United. In the months leading up to the decision, Virginia Thomas founded conservative organization Liberty Central, which used $500,000 in undisclosed money to support Republican candidates in the 2010 midterm elections. In addition, for several years Thomas failed to list hundreds of thousands of dollars his wife earned from the conservative Heritage Foundation on Supreme Court financial disclosure forms.

Federal law requires a judge to "disqualify himself in any proceeding in which his impartiality might reasonably be questioned," or when "his spouse…has a financial interest in the subject matter in controversy…or any other interest that could be substantially affected by the outcome of the proceeding," says Common Cause. Neither Scalia nor Thomas did so in Citizens United.

In these kinds of cases, the law asks: Would a reasonable person who was aware of the situation question Scalia and Thomas's impartiality in the Citizens United case?

This looks like it certainly bears further investigation, and may help answer the question whether our Supreme Court Justices are above the law, or servants of it.

WASHINGTON, D.C. - American Future Fund, a conservative nonprofit group pouring money into the 2010 midterm elections, appears to be violating campaign finance law, watchdog groups said in a complaint filed today with the Federal Election Commission (FEC).

The FEC should investigate whether American Future Fund must register as a political committee for its huge expenditures in the election, making the group subject to recordkeeping, reporting and disclosure requirements, Public Citizen, Protect Our Elections and the Center for Media and Democracy said in the complaint, available at

Chamber of Commerce threatening critics? FBI probe requested.

Just a quick note to point to an item at LegalSchnauzer on threats by the United States Chamber of Commerce and its supporters against one of the Chamber's persistent critics, Velvet Revolution (VR).

Our readers will recall the VR campaign, StopTheChamber.com, as one that was started in 2009 to focus attention to possibly illegal activities of the Chamber, under its chief Tom Donahue,

Yesterday, LegalSchnauzer reported that a new letter has been sent to the FBI by VR's attorney, Kevin Zeese, requesting that the law enforcement agency investigate a series of threats against his organization. 

These reportedly began shortly after launch of the Stop The Chamber campaign and included insults and explicit threats of violence.  They've apparently increased with VR's current advocacy efforts to track other Chamber activities such as the joint campaign financing effort with Karl Rove, AmericanCrossroadsWatch.org

Voter Beware Concentrated Corporate Power is Creating Deceptive Elections

The Republican Party is being replaced with secret donors and unlimited donations as concentrated corporate interests spend hundreds of millions in the Mid-term elections.

In the last week Democrats were gloating about how little money the Republican Party had in its campaign coffers. The Republican National Committee has just over $5 million in the bank for the final stretch of the 2010 midterm election campaign and is carrying over $2 million in debt.

These figures have Democrats jumping for joy, but their excitement is misplaced. The combination of Michael Steele and Citizens United is creating a paradigm shift in how elections are funded among Republicans. Rather than giving to the Republican Party, where Michael Steele controls the money, their name is made public and they are limited by regulation as to how much they can give, major donors have abandoned the RNC and are giving to 527 and 501(c)(4) organizations, which can also take money directly from corporations. This new approach to campaign finance will alter U.S. politics reducing the power of political parties and increasing the power of concentrated corporate wealth.

Election fraud attorney Bob Fitrakis sent letters today to attorneys representing the U.S. Chamber of Commerce and American Crossroads requesting that they retain all documents, emails, accounting records and other records. This “document hold” is the first step toward legal action based on the groups’ alleged laundering of illegal campaign contributions from large corporations.  
 
Fitrakis, in a telephone interview, explained, “We are planning on notifying the groups [as part of our] investigation and we’re requesting that they hold all those documents pertaining to what we believe is an illegal money laundering scheme.”
